Terms of service

1. Who we are

PositionBird is operated by StatusBird LLC ("we," "us," or "our"). "You" means the merchant or business installing the app on a Shopify store. The app is offered to businesses, not consumers.

2. What the service does

PositionBird periodically submits shopping-related prompts to third-party AI answer engines (such as ChatGPT, Perplexity, Gemini, and Claude), analyzes their responses for mentions and citations of your store and competitors you choose to track, computes visibility scores, and suggests optimization actions.

3. Measurement disclaimer — please read this one

AI engines are non-deterministic: the same question can produce different answers between runs, between users, and between an engine's API and its consumer products. PositionBird's scores, mention rates, share-of-voice figures, and trends are statistical estimates based on sampled API responses. They are directional indicators, not exact reproductions of what any individual shopper sees, and we do not warrant their accuracy, completeness, or fitness for any particular decision.

Recommendations produced by the app are general optimization suggestions, not professional advice. We do not guarantee any outcome — including that following recommendations will increase AI mentions, citations, traffic, or sales.

4. Your responsibilities

• Only track brands, prompts, and competitors you may lawfully monitor.
• Do not use the app to violate any law, third-party right, or the terms of Shopify or of any AI engine.
• Do not attempt to probe, overload, reverse engineer, or resell the service, or to use it to build a competing dataset or product.
• You are responsible for anyone who accesses the app through your Shopify store's staff accounts.

5. Subscriptions, trials, and refunds

Paid plans are billed through the Shopify Billing API on the pricing shown in the app at the time you subscribe (monthly or annual). Trials convert to paid subscriptions automatically at the end of the trial period unless you cancel or downgrade first. Subscriptions renew automatically until cancelled. Cancelling or uninstalling stops future charges; fees already charged are non-refundable except where required by law or by Shopify's policies. We may change prices with notice effective at your next billing cycle.

6. Third-party services

The service depends on Shopify and on third-party AI engines and hosting providers. Their availability, pricing, response content, and terms are outside our control, and each engine processes prompts under its own terms. We may add, remove, or substitute engines at any time, including when a provider changes or discontinues API access.

7. Intellectual property

We retain all rights in the app, its scoring methodology, and its branding. You retain all rights in your store data. You grant us a limited license to process your store data (as described in the privacy policy) solely to provide the service. Scan results and reports generated for your store may be used by you for your own business purposes.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCORES, SCAN RESULTS, OR RECOMMENDATIONS WILL BE ACCURATE OR PRODUCE ANY RESULT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STATUSBIRD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE — INCLUDING DECISIONS MADE IN RELIANCE ON SCORES OR RECOMMENDATIONS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the service at any time by uninstalling the app. We may suspend or terminate access for breach of these terms, misuse of the service, or where required by a third-party provider or by law. Sections 3 and 7–12 survive termination. Data deletion after uninstall is described in the privacy policy.

11. Changes to these terms

We may revise these terms from time to time. Material changes will be reflected on this page with an updated date below. Continued use of the app after changes take effect constitutes acceptance.

12. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute shall be brought in the state or federal courts located in Arizona, and you consent to their jurisdiction.
